Ex-Trump Lawyer Appears Before Grand Jury As U.S. Probes Swirl
A federal grand jury investigating Donald Trump‘s retention of secret papers after leaving office heard testimony from Trump’s attorney, Evan Corcoran, on Friday.
Corcoran’s argument that doing so would go against the attorney-client privilege was denied by the judge.
Corcoran’s three and a half hour appearance in secret was yet another indication that Special Counsel Jack Smith’s two ongoing criminal investigations into President Trump, one focused on the documents and the other on his and his allies’ attempts to rescind his election loss in 2020, are progressing. Corcoran and his lawyer Michael Levy walked to the third floor of the federal courtroom in Washington, where the grand jury generally meets.
District Judge Beryl Howell, who directed Corcoran to appear, separately ordered former Trump aides including ex-chief of staff Mark Meadows to testify to another grand jury examining the election-related issues including the Jan.

Prior to Corcoran’s testimony, media outlets reported that Smith’s office had applied to the court for permission to compel Corcoran to testify. This was done in light of evidence that Trump intentionally misled his attorneys about the retention of classified materials at his Florida estate, Mar-a-Lago. Invoking the attorney-client privilege, a legal theory that protects the privacy of private communications between attorneys and their clients, Corcoran sought to prevent the enforcement of a subpoena. The attorney-client privilege could not be invoked to excuse Corcoran from complying with the grand jury subpoena, according to ABC. Howell decided that Smith’s team had established a solid case that Trump may have misled his counsel in furtherance of a crime.
A federal appeals court in Washington upheld that ruling. Prior to the FBI’s August investigation, Corcoran and Christina Bobb, another Trump-representing attorney, engaged in discussions with the Justice Department.
secret documents that were found during the Lago search were kept after he left the White House in January 2021.
Trump was issued a grand jury subpoena in May 2022 requiring him to give over any documents marked “secret.” To enforce the subpoena, Justice Department and FBI representatives met with Trump’s attorneys in June.
